Théophile Pathé, brother of Charles Pathé, works in Berlin in the German branch of the Compagnie Générales des Phonographes, Anciens Etablissements Pathé-Frères.

He joins forces with his cousins Edouard and Eugène Pathé to found Th. Pathé-Frères, a company specializing in the purchase and sale of film equipment. But his brother Charles sued him for misuse of the "Pathé-Frères" trademark.

Théophile therefore registered his new company name in 1906, excluding the word "Brothers", with Morénas as the new partner (whose signature appears on the title). The administrators are Orosdi-Back, Lévy-Picard and René Cahen. The capital is 2 million francs. The head office is located at 99 rue de Richelieu, Paris and will then be transferred to 8, rue Favart.

However, relations remained very tense between Théophile and his brothers, putting Théophile and his company in difficulty. Théophile resigns from his management position and it is Alexandre Promio (whose signature appears on the title), close to the Lumière brothers, who replaces him. But he fails to remedy the situation. The company went into liquidation in 1912 and Charles managed to buy the Théophile Pathé brand. Promio will be prosecuted for mismanagement.
